Regular Council Meeting - May 26, 2009 - 5:30pm

MINUTES

Anderson moved to approve the minutes of the April 28, 2009 meeting; Johnson seconded; passed unanimously.

CLAIMS

Anderson moved to approve the Claims for March 2009 and Claims as of April 26, 2009; Mastio seconded; passed unanimously. Johnson requested that the payment to Ferguson Paving be held out until he has an opportunity to talk with the representative from Ferguson. Claims for both months passed unanimously. March claims totaled $114,447.16 and April claims totaled $65,962.85.

TREASURER'S REPORT-Norman Farha

Farha reported that revenues for March totaled $60,584 and expenditures totaled $67,954 resulting in a loss for the month of $7,370 but gain year to date of $294,520. Unencumbered cash and investments totaled $1,121,032 for 2009. Farha reported that revenues for April totaled $68,836 and expenditures totaled $65,962 resulting in a gain for the month of $2,874 and gain year to date of $297,394. Unencumbered cash and investments totaled $1,166,707 for 2009 as compared to $863,886 for 2008.

CITIZEN'S REQUEST

Dr. Donald Olsen, #8 Colonial Courtpresented plans for constructing a two car garage attached to the house with a workshop behind. The current plans place the structure 7' from the rear property line (North) and 7'6" from the side property line (West). Requirements for both are 15'. Therefore, a variance to the rear yard setback of 8 feet and side yard variance of 8'6" are required for this project to be approved. Reynolds noted in his report that the building will be setting at an angle to the property lines and not parallel creating a triangle shape protrusion into the setback area. Reynolds recommended that Dr. Olsen submit letters indicating the adjacent property owner(s) are aware of the proposed project. Following discussion Anderson moved to approve the variance requests contingent on the receipt of the resident letters; Johnson seconded; passed unanimously.

CLERK'S REPORT-Kay Brada/Barbara Kratzer, Asst.

  1. Brada announced the birth of Anna Elizabeth Brown on May 16th. Kratzer, Assistant Clerk, is the proud grandmother.
  2. Kratzer reported that she had received a call concerning an injury claim at the park. The police report and officer's report have been sent to the insurance company.
  3. Kratzer reported that she had spoken with Mr. Kehr at #30 Park concerning his building permit and directed him to Larry Reynolds.

MAYOR'S REPORT-Thom Rosenberg

  1. Rosenberg reported that he had attended the Annual Mayor's Conference in Topeka. One of the topics of discussion was the changes to the Open Meetings Law. As it relates to Eastborough two members of the council may discuss City business outside Council meetings with the exception of immediately following council meeting.
  2. Rosenberg made the following appointments and asked for Council approval: Laurence Hollis, Municipal Judge; Norman Farha, Treasurer; Kay Brada, City Clerk; Jerry Bogle, City Attorney; Jennifer Wagle, Council President. Mastio moved to approve the following appointments; Anderson seconded; passed unanimously. Discussion of the Municipal Judge position was tabled.
  3. Chief asked if there were any questions concerning his monthly report.
  4. Chief reported that Officer Phammarath, Compliance Officer, has been investigating several residential complaints: #4 Parkwood; #27 Huntington; #5940 E Douglas
  5. Chief asked Council to approve the funds for him to attend a training school in Kansas City in July. Anderson moved to approve the schooling; Mastio seconded; passed unanimously.

CITY HALL MAINTENANCE; ; COMMUNITY AFFAIRS COMMITTEE LAISON AND MUNICIPAL COURT LIAISON COMMISSIONER'S REPORT-Jennifer Wagle

  1. Wagle reported that the search committee for a new chief will be meeting after the May 29th deadline.
  2. Wagle reported that the Beautification Committee has been eliminated.
  3. Wagle asked council to consider two revenue generating programs: Pet identification Program and/or Candlelight Tour of Homes.

UTILITIES; STREET MAINTENANCE; FIRE PROTECTION COMMISSIONER'S REPORT-John Johnson

  1. Johnson reported that Cornejo would begin Phases III and IV of the Street Program on May 26th. Larry Henry will be monitoring the project.
  2. Johnson reported that Ferguson has completed the contracted curb work.

PUBLIC RELATIONS-Thom Rosenberg

  1. Mayor asked Council if they had read the feature article about Eastborough in the Kansas League of Municipalities magazine. Mayor reported that he had received positive comments at the Mayor's Conference and questions concerning our recycling program.

PARKS AND STREET SIGNS COMMISSIONER'S REPORT-David Anderson

  1. Anderson reported that Simpson Construction is making the needed repairs to correct the problems at the Gazebo.
