MINUTES

Anderson moved to approve the minutes of the October 27, 2009 meeting; Mastio seconded; passed unanimously.

CLAIMS

Brown moved to approve the Claims as of November 24, 2009; Mastio seconded; passed unanimously. Claims for November totaled $56,103.51.

TREASURER'S REPORT-Norman Farha

Farha reported that revenues for October totaled $55,546 and expenditures totaled $72,066 resulting in a loss for the month of $16,520 but gain year to date of $403,094. Unencumbered cash and investments totaled $1,261,092 for 2009 as compared to $913,328 for 2008.

CLERK'S REPORT-Kay Brada/Barbara Kratzer, Asst.

Kratzer reported:

  1. Travelers Insurance has denied the claim for the damages in the park. The letter denying the claim was forwarded to Bob Howse, Eastborough's insurance agent for further clarification.
  2. The Annual Chili Feed is scheduled for Friday, December 18th between 11:30 am and 1:00 pm.
  3. Eastborough has been asked and has accepted an invitation to host the Sedgwick County Association of Cities meeting on February 13, 2010.
  4. Request forms are completed to change the December 22, 2009 meeting to December 15, 2009 if Council chooses to. Council elected to meet on December 22nd.

Brada

  1. Handed out copies of the Employee's Salary Summary for review and discussion at the December meeting.
  2. Reviewed with the Council the Set-off Program Report prepared by Cindy Burkemper, Court Clerk and asked for their approval to implement. Following discussion Anderson moved to approve the implementation of the program; Brown seconded; passed unanimously.

CITY ATTORNEY'S REPORT-Jerry Bogle

Bogle reported

  1. Wichita is still working on the south boundary limits.
  2. Currently Eastborough does not have an ordinance regulating rabies vaccinations, but he will prepare a draft ordinance for the December meeting.

MAYOR'S REPORT-Thom Rosenberg

Rosenberg thanked the Council for the flowers and card sent to his wife following her surgery.

POLICE CHIEF'S REPORT-Danny Bardezbain

Chief

  1. Asked if there were questions concerning his monthly report.
  2. Reported that he had reviewed the bids for a Security System at City Hall and recommends Secure Net. The installation cost is higher than some, but the monthly fee is lower. Anderson moved to approve the Secure Net bid; Brown seconded; passed unanimously.
  3. Reported that in his review of the employee compensation plan, he has found some areas out of compliance. Two of the areas include the cap of 40 hours on comp time and the employee's inability to carry over sick and vacation time. The two areas impact the employee at retirement or termination. Report will be prepared for the December meeting.
  4. Still exploring options before ordering a new patrol car.

Brada suggested postponing the salary discussion until after the Chief presents his report. Council agreed to table discussion until January.

Brown reported that he placed on the website a notice about the "Police Benefit Fund". The Mayor agreed to prepare a notice to go out to the residents.

UTILITIES; STREET MAINTENANCE; FIRE PROTECTION COMMISSIONER'S REPORT-John Johnson

PARKS AND STREET SIGNS COMMISSIONER'S REPORT-David Anderson

  1. Anderson asked Larry Henry, MKEC, to report on his findings concerning the erosion issue at #46 Stratford. Henry told the Council that two areas need to be addressed: (1) Engineers need to study the nature of the Channel in order to figure out how to resolve the problem; (2) The proper agencies need to be notified--specifically the Corp of Engineer and the Division of Water Resources which controls water areas. In order to obtain a permit the agencies will need to be supplied with an engineering design and a report on the environmental impact. FEMA may need to be notified. Henry was asked if a contractor reviews the area and has a plan to resolve the issue, does the contractor need a permit. Henry's response was yes. Henry recommended having a survey of the property done which would include the erosion boundary and determine if a dedicated easement needs to be obtained. The cost of the survey/cross section would be a couple thousand dollars. Anderson moved to authorize MKEC up to $3,000 to conduct the survey/cross section; Mastio seconded; passed unanimously.
  2. Anderson reported that there has been no resolution to the duck problem.
