MINUTES

Mayor announced the minutes approved as printed.

CLAIMS

Anderson moved to approve the Claims of as of April 24, 2012 totaling $72,989.88;
Brown seconded; passed unanimously. Claims for April 30, 2012 totaled $91,685.24.

PUBLIC AGENDA

  1. Christine Ostroski addressed the Council on behalf of her husband, their attorney, and herself. She offered two reasons why they were concerned about the passage of Charter Ordinance SP12-01; (a) Since Ordinance G08-06 is still in force the requirements remain the same; (b) Concerned that Charter Ordinance SP12-01 does not allow a procedure for public input prior to passage.
  2. Erin Fulghum, Community Affairs Chairman, asked if there were questions concerning her summary of the Easter Egg Event in the Park. She reported that a large number of people attended the event a number of which were new residents. Council thanked her for emailing her report prior to the meeting for review and all the time and effort she put into planning the event.

TREASURER'S REPORT-Norman Farha

Farha reported that revenues for March totaled $61,609 as compared with $54,950 for 2011 and expenditures totaled $70,688 as compared to $66,905 for 2011. 56% of the Budgeted Revenues have been collected. 13% of the Total Budget has been expended and 21% of the General Fund Budget has been expended. Unencumbered Cash and Investments as of March 31, 2012 total $1,652,603.

CLERKS' REPORT-Ann Townsend/Barbara Kratzer, Asst/Debra Gann, Asst.

  1. Kratzer reported that the balance in the Temporary Note Fund is $7,505.66. These funds will be transferred to the Debt Service Fund.
  2. Kratzer reported that Don Gragg, Trustee for Minneha Township, agreed to send a truck through Eastborough on April 21st to collect fallen limbs from the recent storm.
  3. Kratzer reported that Don Gragg will attend the May meeting to discuss the possibility of providing street sweeping service to the city.
  4. Kratzer asked the Council if they wanted to set a date for the Special Workshop for the Chief to deliver his State of the Department Report. The Special Workshop will be held on May 8th, 5:30pm, City Hall.

CITY ATTORNEY'S REPORT-Jerry Bogle

Bogle reported to the Council that due to the style changes made to Charter Ordinance SP12-01 (Approved 3-27-12), but not published, a new motion will be needed to approve the ordinance. The following changes were discussed and voted on:
(a) Sec. 4, (B) Area Regulations: (v) Minimum floor space per house and (vi) Cost per square foot. Anderson moved to change from 2000 to 1500 the minimum square feet of ground floor space exclusive of porches and garages; change $200 to $150 the minimum construction cost per square foot; Brown seconded; motion passed unanimously.

(b) Sec. 6, Home Business Licensing: Anderson moved to change the wording of the following sentence "Permits will be issued for a three-year period subject to renewal upon payment of a fee of $150" to read: A permit will be issued for a three-year period upon payment of a fee of $150; Brown seconded; motion passed unanimously.
(c) Sec. 6, Home Business Licensing, (E): Shelton moved to change the sentence--Limited amounts of stock in trade may be used or stored on the premises to include "not visible from the street"; Owen seconded; motion passed unanimously.
(d) Sec. 6, Home Business Licensing, (F) Shelton moved to change the wording of the first sentence ending with vehicles used in a home business to vehicles used in a business; Brown seconded; motion passed unanimously.
(e) Sec. 9, Violation and Penalty: Brown moved to change the final sentence by placing a period after City of Eastborough and delete "or any interested persons, as may be authorized by law"; Anderson seconded; motion passed unanimously.
Brown moved to approve Charter Ordinance SP12-01, subject to making the approved changes to the ordinance; Anderson seconded; motion passed unanimously.
Bogle was asked to address the concerns stated by Mrs. Ostroski. Bogle explained that state statues were not followed when the following ordinances were adopted, Ord. G08-06 and Ord. G10-07, therefore they were not valid thus leading to the Charter Ordinance. The Charter Ordinance provides a 61 day period to allow for resident input.

POLICE CHIEF'S REPORT-Chief Bardezbain

  1. Chief asked if there were any questions concerning his monthly report..
  2. Chief reported that the number of citations written were down due to the fact that one officer is on light duty following surgery and the department is in the process of filling a vacancy.

FINANCE; BUDGET AND ACCOUNTING; MEMORIAL GIFTS COMMITTEE LIAISON; LONG-RANGE PLANNING COMMISSIONER'S REPORT- Britt Brown

Brown handed out a list of Council members and their years of service beginning in 1937 to the present. This will be added to the website along with the listing of Mayors.

PARKS AND STREET SIGNS COMMISSIONER'S REPORT-David Anderson

  1. Anderson handed out copies of a proposal to purchase or lease a used Konica Minolta Bizhub C35 color copier to replace the aging Savin copier presently used at City Hall. The total cost to purchase the copier, added 4th drawer, stand, delivery, setup and training is $2,007.00. Monthly maintenance cost is $63.00. Lease option includes Base Monthly Rate of $67.00 plus $63.00 maintenance fee for $130.00 over 36 months or Base Monthly Rate $53.00 plus $63.00 for maintenance fee for $116.00 over 48-months. Following discussion Brown moved to purchase the copier from Lease Finance Partners and sign a maintenance agreement with Digital Office Systems; Brown seconded; motion passed unanimously.
  2. Anderson reported that he had applied for and received a permit which will allow Goose Busters to deal with the geese problem. Goose Busters reports fewer geese around the pond area.
  3. Anderson reported that Jeff Hoffman, President Pond Society, contacted the city requesting permission to place Eastborough City Park on the Annual Pond Tour, July 6 & 7th. Council saw no problem with their request and instructed Anderson to notify Hoffman.
  4. Anderson asked Council if they had reviewed draft Ordinance G12-06 Regulating Smoking around the playground area. Following discussion Anderson moved to approve Ord. G12-06; Brown seconded; motion approved unanimously.

CITY HALL MAINTENANCE; NEWSLETTER-WEBSITE; COMMUNITY AFFAIRS COMMITTEE LAISON AND MUNICIPAL COURT LIAISON COMMISSIONER'S REPORT-Chris Owen

  1. Owen reported that Echo Landscaping has almost completed landscaping around City Hall.
  2. Owen reported that he had spoken with Larry Henry about adding additional parking at City Hall. After reviewing the options Owen and Henry agreed that the cost outweighed the few additional spaces it would provide. Unless Eastborough is prepared to eliminate the backyard Henry did not believe it would be worth the expense. Traffic flow would always remain the central problem.
