ORDINANCE G14-02

AN ORDINANCE ESTABLISHING PROCEDURES AND FEES TO BE CHARGED TO PERSONS FOR ACCESSING AND/OR COPYING OPEN PUBLIC RECORDS

BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF EASTBOROUGH, KANSAS:

SECTION 1. Procedures regarding both inspection and copying of open public records.

The following procedures are hereby adopted:

  1. Consistent with the procedures established by the State of Kansas in K.S.A. 45-215, et seq., (Open Records Act) all City record custodians shall provide full access and assistance in a timely and efficient manner to persons who request access to public records.
  2. Record custodians shall adopt and apply open public record access and copy procedures consistent with the policies of the City and with the provisions of the Open Records Act.
  3. Record custodians shall adopt and apply procedures which will ensure the protection and preservation of public records with respect to the manner in which such records are inspected and copied.
  4. All persons requesting the inspection of or a copy of open public records shall make such request in writing which reasonably describes the records sought.
  5. The record custodian shall require photo identification of any person requesting records.
  6. Any fees for record inspection or for copies are due at the time the records or copies thereof are provided to the requester, unless the record custodian has demanded prepayment of such fees. Fees are to be paid to the record custodian.

SECTION 2. Inspection fee.

  1. Where request has been made for inspection of any open public record which is readily available to the record custodian, there shall be no inspection fee charged.
  2. In cases not covered by subsection (a) of this section, a record inspection fee shall be at the rate of $20.00 per hour per employee engaged in the record search and inspection.

SECTION 3. Copying fee.

  1. A fee of twenty-five cents (25¢) for each 8-1/2" x 11" copy and fifty cents (50¢) for each 11" x 17" (b & w or color) copy shall be charged for photocopying public records. When it is necessary for the information to be mailed, there will be an additional charge assessed to cover postage and handling.
  2. For copying public records which cannot be reproduced by the City’s photocopying equipment, the requester will be charged the actual cost including staff time, to the City.
  3. Other costs are as follows:

SECTION 4. Prepayment of fees.

A record custodian shall require prepayment of the fees established by this Ordinance based upon the best estimate of the record custodian. Any overage or underage in the prepayment shall be settled prior to inspection of the requested record or delivery of the requested copies.

SECTION 5. Effective Date.

This ordinance shall take effect and be in force from and after its publication in the official city newspaper.
