Dogs At Large – Ordinance No. 1088

AN ORDINANCE RELATING TO DOGS RUNNING AT LARGE AND PROVIDING A PENALTY.

BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF EASTBOROUGH, KANSAS:

Section 1.

Harborer Defined. Any person who shall allow any dog or dogs to habitually remain or lodge or be fed within his or home, yard, enclosure or any other premises in which he or she resides or controls within the City of Eastborough shall be considered as keeping and harboring such dog or dogs within the meaning of this ordinance.

Section 2.

The owner or harborer of any dog or dogs shall not allow his or her dog to run at large within the corporate limits of the City of Eastborough; provided, however, that the term “run at large” shall not be considered to include:

  1. the walking or running of a dog that is constrained by a leash and under the direct control of any person of sufficient size or strength to control the dog’s movements; or
  2. a dog on the premises of its owner or harborer.

Section 3.

Any person who either fails to comply with or violates any provision of this ordinance shall be deemed guilty of a misdemeanor, and upon first conviction shall be punished by a fine not exceeding $50.00; any subsequent conviction of the same person shall be punishable by a mandatory fine of not less than $50.00 and not more than $500.00 for each offense.

Section 4.

Ordinance #1007 is repealed.

Section 5.

This ordinance shall take effect and shall be in full force from and after its passage and publication once in the official paper.
