Trash Collection – Ordinance No. 988

AN ORDINANCE PERTAINING TO THE MAINTENANCE, PLACEMENT AND SCHEDULE OF COLLECTION OF RESIDENTIAL TRASH CONTAINERS.

BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF EASTBOROUGH, KANSAS:

Section 1.

The City Council has deemed it advisable to place regulations and restrictions on the maintenance and placement of residential trash containers in order to provide for the health, safety and aesthetics of the community by establishing the following regulations related to their use.

Section 2.

No owner or occupant shall permit to accumulate quantities of refuse or other waste materials within or close to any structure unless the same is stored in suitable containers and in such a manner as to not create a health or fire hazard.

Section 3.

The owner or occupant of every dwelling unit shall provide sufficient and suitable containers to store all residential trash accumulated on such premises between weekly collection periods. Containers shall be watertight and rodent proof with lids or closures maintained in place.

Section 4.

All residential trash containers shall be stored in a manner that they cannot be seen from adjacent and surrounding properties; and such containers shall not be placed for curbside pickup by the refuse collectors but shall be picked up from and returned to their normal storage area by the collector.

Section 5.

Residential trash collection service in the City is prohibited on Saturday and Sunday and shall not be allowed prior to 6:00 a.m. or after 6:00 p.m. Monday through Friday.

Section 6.

Any person convicted of the violation of the provisions of this ordinance shall be punished by a fine of not more than five hundred dollars ($500.00).

Section 7.

This ordinance shall take effect and be in force from and after its publication in the official city newspaper.
