ORDINANCE NO.G12-01

AN ORDINANCE REGULATING MISCELLANEOUS SALES WITHIN THE CORPORATE LIMITS OF THE CITY OF EASTBOROUGH, KANSAS; AND REPEALING ORDINANCE NO. 980

BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF EASTBOROUGH, KANSAS:

SECTION 1.

MISCELLANEOUS SALES DEFINED. The term “miscellaneous sale” means any garage, basement, yard, rummage, estate or other similar sale of six or more miscellaneous items that were originally purchased by the owner and occupants of the residential property upon which the miscellaneous sale is to be held for their ultimate use and consumption.

SECTION 2.

LICENSE REQUIRED. No person shall conduct or carry on in the City a miscellaneous sale without having first obtained a license therefor from the City Clerk.

SECTION 3.

REGULATION GENERALLY. All miscellaneous sales shall conform to the following regulations:

A. Application. Application for the miscellaneous sale shall be submitted to the City Clerk and such application shall contain a statement that all sale items comply with the definition outlined above.

B. Sale Limits. Persons of the immediate family residing with the application shall be allowed one sale per family per calendar year; provided, that such sale shall be limited to three consecutive days. The one sale per calendar year limitation may be waived by the City Clerk for good cause shown.

C. Signs. Temporary non-illuminated signs not more than eight square feet in area advertising the sale are permitted on the property where the sale is located, provided there shall be only one sign per street frontage; provided, however, signage advertising a sale may be placed upon public property on the day or days of the sale and removed upon completion of the sale.

 

SECTION 4.

REPEAL. Ordinance No. 980 is repealed.

SECTION 5.

EFFECTIVE DATE. This ordinance shall take effect and be in force from and after its publication in the official city newspaper.
